Halle Berry's Visitation With Son Maceo Limited In New Court Ruling
Judge grants Olivier Martinez primary physical custody but dissolves temporary restraining order against the actress.

Olivier Martinez won primary physical custody of his teenage son, Maceo, after a family court judge denied Halle Berry’s request for equal time. The ruling marks the latest development in a legal dispute that has stretched over several years. Martinez currently holds sole decision-making authority regarding the boy's day-to-day life, a shift from the joint custody agreement reached during their 2023 divorce finalization.
Berry retains joint legal custody, which preserves her right to participate in major decisions concerning Maceo's health, education, and welfare. However, her in-person time with the boy is now restricted to specific days. The court also ordered mandatory therapy sessions for Maceo as part of the new arrangement.
The conflict intensified when Martinez alleged that Berry physically abused their son, claiming she choked him in one incident. Berry’s legal team disputed these claims. The judge reviewed the evidence and found little merit in the physical abuse accusation, leading to the dissolution of a temporary restraining order that had been placed against Berry.
Both parties participated in closed sessions to present their cases. Martinez expressed satisfaction with the outcome, while Berry’s attorney highlighted her continued commitment to the family's stability despite the ongoing legal friction. The couple married in 2013, separated in 2015, and finalized their divorce in 2023.
The court order leaves one financial question open: the amount of child support Martinez will seek. Berry’s attorney noted that the dissolution of the restraining order was a positive step, but the precise financial terms remain under negotiation as the case proceeds.
