Two former FBI officials no longer face immediate criminal charges for allegedly lying to Congress about the investigation into Hunter Biden. A federal judge in Washington dismissed the case on Monday, citing errors in how the Justice Department handled the prosecution.

U.S. Magistrate Judge Zia Faruqui ruled against Nikki Floris and Bradley Benavides, stating that the investigation appeared to be used as a tool for political advantage. The dismissal ends the specific criminal complaint filed against the pair, though it does not permanently bar the government from trying to bring the case before a grand jury.

The judge found that the timing of the legal action did not match the standard procedures typically used in such cases. Faruqui noted that the Department of Justice could have filed the charges at any point after the events in question occurred in 2023. Instead, prosecutors opted to file the complaint just two weeks before the midterm elections scheduled for Tuesday.

"I will not bury my head in the sand and pretend that I cannot read a calendar," Faruqui said from the bench. He argued that the delay in bringing the case until the election cycle raised questions about the motivations behind the prosecution.

The ruling follows a preliminary hearing where the judge questioned the methods used by prosecutors. He criticized the Department of Justice for filing an amended complaint with an additional charge overnight. This was done directly to the docket without first seeking permission from the court, a procedure Faruqi said he had never previously observed.

Testimony from an FBI agent who worked on the case supported the judge's concerns regarding political influence. The agent stated that the investigation began one day after President Donald Trump delivered a primetime speech on election security. That speech took place in July and focused on grievances regarding the 2020 election loss.

The agent also testified that FBI Director Kash Patel mandated the investigation and kept close track of its progress. Faruqui highlighted this oversight in his decision, suggesting that the high level of attention from the agency's leadership contributed to the perception that the case was politically driven.

The original charges alleged that Floris and Benavides misled members of Congress in 2023 about their roles in investigating a laptop belonging to Hunter Biden. The laptop was dropped off at a repair shop in Delaware in 2019. The Justice Department argued that the officials' statements obscured the extent of their involvement and knowledge of the probe.

The case was linked to broader Republican criticism of the FBI's actions during the 2020 presidential campaign. Republican Senators Chuck Grassley of Iowa and Ron Johnson of Wisconsin previously claimed that a defensive briefing provided by the officials was used to undermine their inquiries and connect the administration to Russian disinformation. Candidate Joe Biden, the Democratic nominee, defeated incumbent Donald Trump in that election.
